Curiouser Terms and Conditions
Thank you for choosing to create an account with Curiouser, we’re delighted to have you on board! For the purposes of these terms and conditions, “Curiouser” will refer to any classes operating under the Curiouser Group umbrella including, but not limited to, Messy Monkeys, Music, Drama and Art. Curiouser offers a variety of different play sessions for your children, which we call the “Sessions” that we deliver. From babies to young children, we have Sessions for everyone and you can find out more about the Sessions that we offer through our “Website” at www.curiouser-family.com
The Curiouser Family Hub is owned and operated by Curiouser Group LLP a limited liability partnership with company number 13819161 and whose registered office is located at 194-196 Finchley Road London, NW3 6BX, United Kingdom. When we use words like “Curiouser”, “we”, “us” and “our” in these Terms, it is to the Curiouser Group LLP that we refer. Likewise, when we use words like ‘you’ and ‘your’, we are referring to you as the parent or legal guardian wishing to engage in one of the services Curiouser provides.
This set of terms and conditions, or “Terms'' for short, applies to everyone who wishes to use our Website and any of our content. Please read these Terms carefully as upon accepting these Terms and submitting the booking form, there will be a legal contract between you and us. Unfortunately, if you don’t accept these Terms, you won’t be able access our Website or use any of its’ features.
Safety and Safeguarding
For any classes that you attend with your child, it is your responsibility to keep your child safe during their time with Curiouser - your child remains solely your responsibility at all times. Curiouser does not assume any liability for any harm or injury suffered to you or your child in which you also attend. For information on safeguarding procedures regarding classes in which your child attends independently, please see the Sessions and Liability section.
Illnesses
It is your responsibility to ensure you do not come to the Curiouser Family Hub or attend any of our classes if you, your child, or anyone in your household are displaying any symptoms of any illnesses, particularly contagious diseases such as Covid 19 or Chickenpox. We have a flexible make-up policy, so please only bring your child if they are healthy. You understand that class leaders have the right to turn you away from class if they are concerned that you are symptomatic. You understand that Curiouser can not mitigate against all risk - if you want to see a copy of our risk assessment, including our Covid-19 policy, please contact info@Curiouser-family.com.
It is your responsibility throughout the class to follow the safety measures outlined to you by your class leader and you understand that you may be asked to leave the class if you are unable to follow these measures - these are things like waiting in an allocated space before class starts, washing hands before class, ensuring your child stays within their allocated space and doesn't use other children's resources and leaving in a timely manner.
It is your responsibility to let your class leader know if you present any symptoms of coronavirus in order that the Track and Trace system can be implemented for other class members.
Food and Beverages
You understand that you must not bring any food or drink, excluding water, into any of our Session, unless you have received an exemption, in writing, from a Curiouser employee, and that you may be asked to leave the session if you cannot adhere to these rules.
If attending a cookery class, you understand that your child is your responsibility when handling, cooking and consuming any food created in the class.
It is your responsibility to not bring any food that is on the Curiouser allergy list. The Allergy list is as follows (last updated XXXX):

Medical Information
When you book a Session it is a requirement, and your responsibility, to input on Curiouser’s booking form any allergies and medical conditions that your child has. It is also your responsibility to keep this information up-to-date through the ‘My Bookings’ page on the website. All the materials used in each Session are very safe and child friendly but we will not be liable, other than through our own gross negligence, for any injury or illness caused to your children as a result of them having an allergic reaction/medical response to any materials used in the Session should you not have provided sufficient information concerning your child when asked whilst making your booking.
Personal information
We use our bespoke Curiouser booking system to process your bookings. We require some basic information from you in order to complete a booking for one of our Sessions. You can only book our Sessions directly through the ‘Classes’ pages on our Website and to do so we require your full name, address, email, telephone number and emergency contact information. We also require your child’s name, date or birth and details of any allergies and medical conditions that your child has. You must also include the details of the person who will most often be dropping off/picking up your child. In submitting your booking, you confirm that the information you are providing to us during the process is accurate and up-to-date.
Booking Procedure
During the booking process, for some classes you will need to select which venue, dates and times you are able to attend. The cost for each Session or group of Sessions will be outlined on the Website before you access our booking page. If you have a Class Pack, the number of credits that each class cost will also be visible. The total amount payable will then be due once you’ve submitted the booking form and you will be required to make payment via our payment processor or by bank transfer to confirm your booking. All Sessions are booked on a ‘first come, first served’ basis and your place on a Session will not be confirmed until payment has been received by us. Your Class Pack
A Curiouser Class Pack is transferable, refundable but it is non-exchangeable, and is valid for exactly one year from the date of purchase (for the avoidance of doubt, this start date is the one on the email sent to you confirming your Class Pack purchase has been successful). Any session booked using a Class Pack must be pre-booked and the receipt of a Class Pack does not guarantee you a space in any Session if it is already at capacity.
Your class pack may be shared with others, but any new participant must be registered as a new child on your account, and you understand that, if you do not provide their essential information (including, but not limited to, emergency contacts and medical information), we reserve the right to refuse entry, in accordance with our Safeguarding Policy.
If you can no longer use your Class Pack, you understand that it can be transferred to another person at no extra cost. You can also request a full refund up until your first credit has been used. If you have used 3 or less credits, you can request a refund for 50% of the total value of your pack. Once you have used 4 or more credits, you understand that your Class Pack is no longer eligible for a refund, barring exceptional circumstances outlined in writing by a Curiouser representative.
Session Rescheduling
You understand that within 12 hours of any Session’s start time, your class is non-refundable nor able to be rescheduled, and if you do not attend you will still be charged, barring exceptional circumstances as confirmed in writing by a Curiouser representative.
Session Cancellation
If you choose to cancel a class, you understand that you are not eligible for a refund for that class unless Curiouser confirms so in writing, regardless of when the cancellation occurs. If for any reason Curiouser has to cancel a class we will make arrangements for an alternative Session for you and your children.
Session Refund
For any Session booking that is confirmed (i.e. payment has been received and a child’s name has been added to our register), Curiouser is unable to offer refunds on that class. If for any reason you are unable to attend a booked class, Curiouser will endeavour to help you reschedule your class by providing you with a list of alternative class dates, venues and times.
Refunds may be given in exceptional circumstances, and these will need to be confirmed, in writing, by a Curiouser representative.
These Terms
These Terms will always be able to be viewed on our website, and are available for printing if required. If you do print, please be aware that the Terms might change in the future, for example if we add functionality to our Website or vary any of the Sessions that we offer. We reserve the right to make changes to these Terms and if we do so we will contact you to let you know that the Terms are to change, what those changes are and when the changes will come into effect. If you continue to use our Website and to attend our Sessions after this point, you will do so having accepted the new version of the Terms.
Use of our website
We own all of the framework and content that makes up our Website. That includes all the ‘copy’, the code, the look and feel and the trade marks and graphics. You only have the right to use all of that in browsing the Website or booking a Session in accordance with these Terms. Our logo is a registered trademark and the copyright in these Terms and the other legal documentation you see on the website is owned by our lawyers and licensed to us for this purpose. If you’d like to make use of any of our images or the content from our Website then we may allow you to do so at our complete discretion. You may not use our website for any unlawful purpose. You may not copy, reproduce, download, broadcast, transmit, publish, store, modify, or otherwise commercially exploit or use any of our website, without Curiouser’s written permission.
You may access and review all pages of our website and print individual pages of the site (but you may not photocopy them other than for your own personal, non-commercial use). Except as set out in this paragraph, no licence is granted to use any intellectual property or other right in or to our website in any manner whatsoever.
Third Party Extensions
The potential appearance of external hyperlinks on our website does not constitute endorsement by Curiouser, its subsidiaries and affiliates of the opinions or views expressed by these third party websites, and Curiouser does not verify, endorse or take responsibility for the accuracy, currency, completeness or quality of the content contained at these sites. Furthermore, Curiouser is not responsible for the quality or delivery of the products or services offered, accessed, obtained by or advertised at such sites. As such, neither Curiouser nor its subsidiaries and affiliates will be responsible for any errors or omissions or for the results obtained from the use of such information contained in these sites. Finally, Curiouser will under no circumstances be liable for any direct, indirect, incidental or special loss or other damage, whether arising from negligence, breach of contract, defamation, infringement of copyright or other intellectual property rights, caused by the exhibition, distribution or exploitation of any information or content contained within these third party hyperlinked sites.
Curiouser is committed to complying with the Data Protection Act 1998 and The Privacy and Electronic Communications (EC Directive) Regulations 2003. We collect data for any transactions you carry out through our website and in our family hub, so that we can honour your booking and provide you with the services you have requested and purchased.
Intermittently, Curiouser will give you information relating to our Sessions and Website. This might be information about new functionality or old functionality that we are going to withdraw. It might be to let you know that we have made changes to these Terms or the Privacy Policy. We will send this information to you in the form of notifications when you access our Website. We might also send an email to the address you have given us when booking. English law requires that certain information that we might have to pass to you has to be in writing, so you accept that information we provide to you electronically is indeed ‘written’ for this purpose.
If, for some reason, you need to communicate with us for contractual purposes, you can do this by email addressed to info@Curiouser-family.com.
Information that we send to you or you send to us for contractual reasons will henceforth be called ‘Notices’ for the purposes of these Terms. There may be times when all parties need to know when such a Notice was received. Those Notices will be deemed to be received as follows: a notice sent by us to you, or by you to us, via an email will be regarded as having been received the day AFTER it is sent, thus ensuring a reasonable amount of time to be received and read.
If at some point in the future, a court or some other authority has cause to review these Terms and in so doing, rules that some or other part of them is invalid, unlawful or unenforceable, there will be two consequences. First, everybody accepts that the rest of the Terms will remain in place between us and that the contract will survive intact with the problematic element removed. Second, the authority or court taking action may compose a replacement for the stricken terms that do as good a job as reasonably possible as the job previously done by the terms removed or, where the authority or court taking action declines to do so, you agree that we may replace those terms ourselves with something else that complies with the ruling.
Everything relevant to our contractual relationship with you is set out either in these Terms. We have no earlier contractual arrangement or understanding with you or any sort. In submitting your booking and accepting these Terms, you must acknowledge that you haven’t relied upon any statement made or promise given by us, whether stated plainly or implied from our conduct UNLESS that representation or statement is repeated in these terms.
This concludes these Terms and as soon as you have completed your booking through our Website, you will have a binding contract with us.
